Schedules of Condition and Dilapidations

Commercial/Industrial and to a lesser degree Retail leases invariably impose Full Repairing/Decorating liability on the Tenant. It is therefore of prime importance, when considering taking a lease of premises, that the Tenant should be aware of potential repairing obligations and a Schedule of Condition will serve to protect the Tenant.

During the currency of/or at lease determination, a Landlord may serve a Schedule of Dilapidations and Wants of Repair on the Tenant. It is important that both Landlord and Tenant are aware of Civil Procedure Rules, which govern proceedings in Civil cases and a pre-action protocol, which was amended in 2008 (Version 3).
